Custodial father is concerned that mother is unstable; and her recent arrest has him very worried

Your Question:
I AM THE FATHER OF FOUR MINOR CHILDREN WHO ALL RESIDE WITH ME AFTER A BRUTAL DIVORCE. THEIR MOTHER IS UNSTABLE SHE SPENT 4 MONTHS IN A PSY. HOSPITAL. IN OUR DIVORCE SETTLEMENT I AGREED TO JOINT LEGAL CUSTODY AND EVERY OTHER WEEKEND VISITATION AND HALF THEIR SCHOOL VAC. MOST RECENTLY IN A VISIT WITH THEIR MOTHER THE POLICE WERE CALLED AND THEIR MOTHER WAS REMOVED FROM HER HOME FOR DOMESTIC VIOLENCE AGAINST HER BOYFREIND. THE POLICE CALLED ME TO RETRIVE THE CHILDREN. NOW THE MOTHER FEELS SHE DID NOTHING WRONG AND IS PRESSURING ME TO LEAVE THE 2 YOUNGEST CHILDREN WITH. I FEEL THAT THIS IS NOT IN THE BEST INTERSET OF THE CHILDREN. WHAT CAN I DO? THE MOTHER HAS A LONG HISTORY OF DRINKING AND HAS BEEN DIAGNOSED AS BI POLAR. PLEASE HELP ME!!!

My Answer:
Hello,

ALL CAPS is so annoying to read.

I suggest you seek Ex Parte orders for supervised visitation of the mother pending the outcome of a court-ordered psychological evaluation of her.

If you have a police report, or any evidence that you were called to get the children because the mother was arrested, that would help you.

If you have no idea what "Ex Parte" means, you should hire an attorney on Monday and try to be in court no later than Wednesday.

The longer you wait, the more you implicitly demonstrate that there is no true emergency.
